Temporary Construction Noise

An exemption to the City's Noise Control Bylaw 5122-1994 may be considered where it is impossible or impracticable to comply with regulations outlined in Section 6 Temporary Construction Noise. 

As per the City's Noise Control Bylaw 5122-1994, Section 6 Temporary Construction Noise is permitted Monday to Saturday between the hours of 7:00 am & 9:00 pm and not at all on Sunday or Statutory Holidays (as defined in the provincial Interpretation Act).  

Construction noise means any noises or sounds made on or associated with a construction site, in carrying on work in connection with the construction, demolition, reconstruction, alteration, or repair of any building or structure, in carrying on any excavation or other operation, or in moving or operating any machine, engine, or construction equipment. Construction activities that take place quietly indoors and don’t disturb neighbours, such as painting or electrical installations, are permitted at any time. 

Section 7 of the bylaw allows an exemption outside of these days and hours with prior written consent from the City, as on occasion sites may need to complete construction work such as large continuous concrete pours that cannot be completed within the allowable hours. An exemption permit application must be submitted to the City's Bylaw Department prior to working outside the allowable hours, approval is not guaranteed, and it is expected that no work will take place until approvals have been granted.  

A complete noise exemption application should include:   

  • All sections of the application form completed accurately. 
  • Draft notice to be distributed to area business/residents in the neighbourhood adjacent to the proposed work area. Notices are required to be distributed a minimum of 72 hours before commencement of the work. 
  • Map outlining where the notices will be distributed. 

Noise exemption requests require 7 full business days to review once all pertinent information is received.
